IPL stars may lose one-fifth of earnings as tax

NEW DELHI: The Income Tax department which is probing all financial transactions of the Indian Premier League (IPL) has advised all foreign players to obtain PAN cards, failing which they will have to pay penal tax on their cricket related earnings in India.
Permanent Account Numbers are issued by the I-T Department to track all earnings and tax deductions. A new rule notified by the Central Board of Direct Taxes (CBDT) and effective from April this year makes it mandatory for all foreign nationals to register for PAN cards.

All cricket players who have not procured a PAN card will have 20 per cent of their earnings deducted as tax. This is double the 10 percent TDS (Tax Deducted at Source) recovered from PAN card holders.

"The law will also apply to all non-residents in respect of payments or remittances liable to TDS," the notification states.

The new clause has to be read with section 115BBA of the Income Tax Act which ensures tax on non-resident sportsmen or sports associations where the total income of the player, who is not a citizen of India and is a non-resident, includes any income received or receivable by way of participation in any game in the country, a senior I-T officer said.

For example, West Indian all-rounder Kieron Pollard who is paid Rs 3.42 crore to play for Mumbai Indians, will have to pay almost Rs 64 lakh as penal tax for not having a PAN card. New Zealander Shane Bond who is the pace-bowling spearhead for team Kolkata Knight Riders, will also have to pay a similar amount by way of TDS till he obtains a PAN card.

The rules also cover sports commentators, umpires, team coaches, physiotherapists, TV anchors and sports columnists for their earnings in India. The exact amount of penalty will depend on the actual payment made to individual foreign players.

Top I-T sources said the department in its probe is looking for documents where the foreign players could have participated in advertising assignments and written articles in newspapers and journals during the IPL. Those earnings are also taxable.

"All deductees, including non-residents having transactions in India liable to TDS, are advised to obtain PAN by March 31, 2010 and communicate the same to their deductors before tax is actually deducted on transactions after that date," the CBDT notification said.

I-T officials say it takes only 10-15 days to procure a PAN card. IPL franchisees and their accountants can help foreign players who are not familiar with Indian tax requirements.

Govt nets Rs 110 crore from IPL 3

The third edition of the Indian Premier League is turning out to be a money spinner not only for the organisers but also for the taxman.

The Government has already mopped up over Rs 110 crore as tax deducted at source (TDS) in the first fortnight of the event , which began on March 12 and is to run for six weeks. 

The Revenue Department has, till date, collected TDS of Rs 50 crore on payments made by franchises.

The TDS on various incomes received by the Board for Cricket Control in India towards IPL-3 stood is at about Rs 61 crore, official sources said.

The TDS on certain expenses by BCCI resulted in TDS mop-up of Rs 5 crore. The TDS collections for IPL-1, which was held in India in 2008, were about Rs 90 crore. The Tax Department did not get much from the second edition of IPL as it was held in South Africa.

Currently, there are eight franchises and two more would join next year. These eight teams were auctioned in 2008 for $725 million, slightly higher than the auction amount of $703 million garnered from the latest entrants — Pune and Kochi — on March 21.

Last year, Multi Screen Media and World Sport Group bought the telecast rights for IPL for Rs 8,200 crore for nine years. The contract runs up to 2017-18. IPL gets only 20 per cent of the broadcast fees, while 72 per cent is distributed among franchises and the remaining 8 per cent is for prize money.

speculation on who’d win the two new franchises for the
Indian Premier League’s (IPL’s) fourth cricket season in
2011 came to an end, as both the Videocon Group and
Adani Enterprises, touted as frontrunners, lost.



Instead, in a morning full of surprises in Chennai today, the
Sahara Adventure Sports Group emerged top bidder,
paying $370 million (Rs 1,702 crore) as the franchise price
for Pune. This was 64 per cent higher than the base price se
t for the auction, at $225 million (Rs 1,035 crore).

The other franchise on offer was bagged by a Kochi-based
consortium of businessmen, Rendezvous Sports World Ltd,
which won the Kochi franchise for $333.33 million (Rs 1,533.3 crore).

For the first season, in 2008, when the existing eight teams
were brought under the hammer, Reliance Industries had made
the highest bid at $112 million (Rs 515 crore) for Mumbai Indians.

While the existing eight teams had been sold for a
total of Rs 3,330 crore in 2008, the two new teams
managed to bag Rs 3,235 crore for IPL.

“This clearly shows IPL is recession-proof and I hope they will
make good business,” said its chairman and commissioner, Lalit Modi.

He said five bidders had participated in the auction — Rendezvous,
Sahara, Adani Group, VC Digital Solution (Videocon) and
Amonar Pvt Ltd. The cities on offer were Cuttack, Ahmedabad,
Nagpur, Dharamsala, Indore, Visakhapatnam, Pune and Kochi.

While the franchisee fee would be paid over the next 10 years
by the winning bidders in equal instalments, both Sahara and
Rendezvous are to also pay $37 million (Rs 170 crore) and $33.33 million 
(Rs 152 crore), respectively, as bank guarantees to IPL by Tuesday.

Sahara had placed competitive bids for three cities
— Ahmedabad, Nagpur and Pune —
and eventually chose Pune.

The other bidders which showed interest for
Pune was Amonar, which quoted $261.3 million (Rs 1,203.36 crore) and
Videocon, joined by Bollywood superstars Saif Ali Khan and Kareena
Kapoor, which quoted $319.9 million (Rs 1,471.5 crore).

The Adani Group had quoted $315 million for Ahmedabad.

Rendezvous World Sports had placed its bid for Kochi with
consortium partners Pavinee Developers, Anchor Earth, Filmwoves
and Anandshah Developers. “At present, Kerala does not have any
cricket stadium, but Kerala Cricket Association has said they are in
the process of building one. Till that time, the bidder
(Rendezvous Sports World Ltd) will be provided with an alternative venue,
anywhere in India,” said Modi.

He added that IPL would now feature 10 teams and a total of 94 games,
from the existing 60 games. “The Twenty20 tournament will not see any
more expansion in the near future. In fact, I don't foresee an expansion in
many, many years to come but, then, you never know," Modi said.

Now are there plans to hold the IPL abroad in future, although we
will play exhibition matches in foreign countries, said Modi.

IPL had invited bids for the franchises for two new teams in February
and was supposed to declare the winners on March 7.
However, it had to modify its tender norms after getting only
two bids for the two teams on offer. Most prospective bidders
balked at the stiff financial terms of the earlier tender.

IPL later made three major changes for the new tender.
The $100-million (Rs 460 crore) performance guarantee
was brought down to $10-million (Rs 46 crore), to be given
24 hours before the bid. The bank guarantee, to be given
within 48 hours of winning the bid, was brought down
to 10 per cent of the winning amount, from 100 per cent earlier.

The most important change was the withdrawal of the net
worth clause.

In the earlier tender it was $1 billion (Rs 4,600 crore).
